Introduction: The European Commissioner for Competition, member of European Commission (EC), in 2000, opened up an antitrust investigation on Microsoft Corp. (Microsoft), alleging that it used its dominance in the Operating Systems (OS)market to stifle competition in the server software market. This was the second antitrust case against Microsoft, the first one being that filed in the US in 1997. The EC’s complaint was different fromthe one in the US, where the US Department of Justice (DOJ) accusedMicrosoft of protecting its dominant position in Personal Computer (PC) OS market by taking measures that were aimed at weakening Netscape Navigator’s Internet browser and Sun Microsystems’ (Sun) Java software. In 2001, Microsoft reached a settlement with the US antitrust authorities. This settlement according to its rivals was a mere slap on the software giant. ThoughMicrosoft had settled its antitrust case with Federal authorities in the US, it still had to deal with the EC’s commissioner, Mario Monti (Monti). Experts speculated that Monti, who was known as ‘SuperMario’ for his stringent enforcement of antitrust laws, would be heavy onMicrosoft. “The fact that the US government entered into an incredible sweetheart deal is not going to impressMr.Monti. He has shown he is willing to be tougher,” said, Robert H. Lande, a law professor at the University of Baltimore. |
